1. Introduction

Please read this carefully as it sets out the terms of a legally binding agreement between you and the Manx Museum and National Trust (Manx National Heritage).

These terms and conditions of use ("these T&Cs") apply to the subscription, use and access to the online Newspapers and Publications service ("the Service") provided by the Manx Museum and National Trust.

The Manx Museum and National Trust (of Manx Museum, Kingswood Grove, Douglas, Isle of Man. IM1 3LY, British Isles) is a trust established by the Manx Museum and National Trust Act 1959, and a registered Manx charity (no 603) and trades as 'Manx National Heritage'. (Throughout these T&Cs Manx National Heritage shall be referred to as 'we', 'us' and 'our'.)

It is possible to view and search the website (www.newspapers.gov.im) from which the Service is accessed ("the Website") without registering online or paying a subscription. However, only accessing the Service from our premises or by registering and paying the subscription fee will you be able to gain full access to the Service which includes viewing fully the results of your newspapers and publications searches, flagging up your interests with Manx National Heritage and/or receiving email updates from us about those interests. By subscribing you must confirm that you accept these T&Cs and so by subscribing to use the Service you are agreeing to these T&Cs.

If you wish to register with us or to purchase a subscription from us you will also need to agree to the Isle of Man Government’s Online Services Terms and Conditions through which the Manx National Heritage newspapers and publications Service is provided. These T&Cs incorporate any other policies and /or terms and conditions referred to and by accepting these T&Cs you will also be accepting the terms of all or any such policies and/or terms and conditions.

Online services uses Cookies to create the most secure and effective website possible and to improve the visitor experience. By using this site, you agree to the use of cookies.

If you use the Service in the course of your business or work you are agreeing to these T&Cs on behalf of that busines.s

If you do not agree with the T&Cs (or are not authorised to do so on behalf of your business or work) you should not register with the Service.

2. What you can use the Service for?

You can use the Service for your own personal non-commercial use. This means you can use the Service to subscribe to the Newspaper and Publications which enables you to access fully, download and print material.

We are also happy for you to help out other people by telling them about the Newspapers and Publications service and other information available on the website and how and where they can be found. However, you must not provide them with copies of any of the newspapers and/or publications (either an original image or the information on the results page), even if you provide them for free other than through the in-built Newspapers and Publications service email facility.

You are not permitted to use the Website or the Service for commercial, business or professional use or gain, other than with prior written agreement from us.

3. Registration and Subscription

In order to use the Service you will need to register with Online Services and be signed in with an active subscription to access the full images.

If you are under 16 we recommend you should not register unless you have permission from your legal guardian (usually a parent) to do so.

Keep your sign in details private at all times, do not share them with anybody, and let us know if you think somebody else has access to them. Do not keep yourself signed in unless you are using your own personal computer. Please keep your personal information accurate and up to date, especially your email address.

We offer different types of subscription which give you a choice of subscription periods at a range of prices. Please note your subscription access and validity commences immediately upon the acceptance of your payment. We will try to process your subscription promptly but cannot guarantee that your subscription will be activated by any specified time. By submitting your payment details you are making an offer to us to buy a subscription. Your offer will only be accepted by us and a contract formed when we have successfully verified your payment details and email address at which point we will provide you with access to your subscription. We reserve the right to reject any offer at its discretion for any or no reason.

When you submit your payment details you confirm that you are authorised to purchase a subscription using those payment details. If you are entitled to a refund under these T&Cs we will credit that refund to the card and should it have expired we will contact you.

Once you have purchased a subscription you have unlimited full access (for the duration of your active subscription) to the Service. This is subject to routine maintenance and upgrades to the Website. Wherever possible we will notify you in advance of routine downtime of the Website.

When you purchase a subscription, it is on a time limited basis meaning that your subscription will NOT automatically renew. Upon expiry of your subscription full access to the Service will cease, but your Online Services Registration will remain valid unless you de-register by contacting the Online Services Help Team or by administering your own Online Services account by clicking here.

We will send you an automated reminder email in advance of the expiry of your subscription so that you can renew your subscription. Any renewed subscription will run from the end of the current active subscription. Details of your subscriptions are accessible by viewing your iMuseum services account within Online Services.

4. Your Privacy - personal data and payment security

Personal data gathered during registration with Online Services will be processed in accordance with the Data Protection Act 2002. For details of the Privacy Policy and Cookie Policy that apply whilst registering to use Online Services please see the links to Cookies and Privacy at the bottom of the page.

Your credit/debit card details are not stored. In the event of a problem in processing your payment, we will contact you using the telephone number and/or email address you have supplied as part of your Online Services registration.

The Privacy Policy that applies to Manx National Heritage services is outlined within the Manx National Heritage Privacy Policy.

5. Cancellation and your right to a refund

In view of the nature of the Service, if you purchase a subscription you can contact us to cancel your subscription and request a refund within seven days of receipt of our confirmation email of you having successfully activated your subscription. We will happily give you a full refund subject to our verification of whether you have used the full subscription service.

However, you agree that once we have started providing any part of your subscription you do not have the right to cancel your subscription or any part of it. This means that you are not entitled to a refund once we have started providing any part of your subscription to you except in the limited circumstances referred to in these T&Cs. Although you may inform us of your intention to cancel your subscription at any time notice of cancellation will only take effect at the end of your current subscription period.

We reserve the right to cancel your subscription with or without notice and without further obligation (in which case you will not be entitled to any refund) if you:

  1. breach these T&Cs
  2. if we cannot secure a payment for a subscription
  3. if you persistently offer to other people and provide them with Content; or
  4. use a personal subscription for professional purposes.

If, however, we terminate or suspend your subscription for any other reason or cease to provide the Service, unless there are exceptional circumstances, we will provide you with a pro rata refund to your payment card refunding any amounts you have paid us in advance which relate to any remaining and unexpired period of your subscription.

6. Availability and Changes to the Website or Service

The availability of the Website and/or the Service is not guaranteed. These are provided on an ‘as is’ basis and are subject to change. We do not warrant or promise that the Website or Service will always be available or fully functional and reserve the right to withdraw the Website and/or the Service at any time and will not be liable to you for any losses you might suffer.

In the event we are notified that any of the material featured on the Website (whether material provided by us or user generated content) potentially infringes the rights of any third party, we reserve the right to remove that content. The content will remain removed until we have conducted our investigation into the allegations made and may be permanently removed depending on the outcome of our investigation.

As a subscriber, you may have access to additional newspaper and publication information viewed at no extra cost during the period of your active subscription.

At our discretion, we may vary the subscription price for specific users, groups or individuals. If we launch a major new collection, we also reserve the right to make a separate charge for it.

We reserve the right to make changes at any time to these T&Cs, provided that any such changes will be notified by email.

7. Things beyond our control

If we are prevented or delayed in the performance of our obligations under these T&Cs arising from or attributable to acts, events, omissions or circumstances beyond our control, including but not limited to, acts of God, perils of the sea or air, fire, flood, drought, explosion, sabotage, accident, embargo, riot, civil commotion or decisions of a civil authority including acts of local government and parliamentary authority; breakdown of equipment; telecommunication failures; epidemic; war; terrorism; extreme adverse weather conditions; and labour disputes of whatever nature and for whatever cause arising including, but not limited to, work to rule, overtime, strikes and lockouts, then we will notify you of the circumstance and will be excused from the performance or the punctual performance as the case may be from the date of notice we provide you with for so long as such cause of prevention or delay continues. We will not be liable to you for any loss you may suffer as a result of circumstances beyond our control.

8. Fair Use, Copyright and Intellectual Property Rights

We have a fair use process in place for the (very rare) cases where people might abuse the Service, this is outlined below.

Registered users and new Registered users may use promotional codes offered by us to provide extended or free access to a subscription. You are not permitted to share or abuse the use of a promotional code. If you create pseudo accounts to take advantage of a promotional offer, share promotional codes or use the offer for professional purposes, we reserve the right to stop your subscription access and to terminate our agreement with you.

If in our reasonable opinion there appears to be abnormal or unfair use of promotional codes, we reserve the right to withdraw promotional codes without giving notice to new or current users. We will regularly review the use of promotional codes based on the usage of the site by all users.

You can transcribe and quote from content obtained from use of the Service ("Content") that is out of copyright; use Content that is still in copyright in accordance with the exemptions set out in the relevant copyright legislation, and which includes using Content for private study, research for non-commercial purposes (provided a suitable acknowledgement is included), and criticism, review and news reporting (again provided a suitable acknowledgement is included).

You indemnify us from and against any and all claims, liabilities (both joint and several) losses, damages, costs and expenses (including any fines, legal expenses on an indemnity basis, expert witness fees, expenses and costs of settlement) arising out of or in connection with your use of the Content should it infringe the intellectual property rights of a third party.

We are happy for you to help out other people by telling them about the Service and other online content we provide and how and where they can be found. However, you must not provide them with copies of any of the Content, even if you provide it for free.

You are not permitted to use the Content for commercial, business or professional use or gain without first seeking our permission. Nor are you permitted to copy the newspapers and publications and share this with your friends, family, colleagues or any third party whether in physical hard copy, email other than through the in-built Newspapers and Publications service email facility. We hold high-quality, publication standard versions of all our Newspapers and Publications Content which may be licensed for use or a print made on request. Please email us to find out about our charges; costs depend on how and where you want to use the Content.

All intellectual property rights (including, without limitation, all database rights, rights in designs, (in all cases whether registered or unregistered and including all rights to apply for registration) and all other intellectual or intellectual property rights in any jurisdiction) in any information, content, materials, data or processes contained in or to this website belong to us or to our licensed source. No intellectual property rights in any Content are transferred to you.

9. Legislation

These T&Cs will be governed and construed in accordance with the laws of the Isle of Man and each party irrevocably agrees to submit to the non-exclusive jurisdiction of the courts of the Isle of Man.

Liability: The only warranties or promises we give are set out in these T&Cs and in so far as we are permitted to do so by law, all warranties in respect of the Website and Service are excluded. We do not accept liability for any indirect or consequential losses, loss of data or any use of Content you suffer from using the Website and/or Service, although we cannot limit liability for personal injury or death caused by our negligence or fraud. For any other loss you suffer that is caused by us, we limit the liability we have to you to the total money you spent on the Website in the 12 calendar months before you make a claim against us. Your statutory rights are not affected.

Assignment: These T&Cs are personal to you, and you are not allowed to transfer your rights there under to anyone else.

Severance: If any part of these T&Cs shall be held illegal or unenforceable, such provision shall be deemed separate and divisible from and shall in no way affect or impair the validity or enforceability of, the remaining provisions.
